These Terms of Use ("Terms") govern your access to and use of the website operated by Plus Ultra Limited, a private company limited by shares incorporated in Hong Kong SAR under the Companies Ordinance (Chapter 622), Company No. 80642335 ("Company," "we," "us," or "our"), including all content, functionality, and services offered on or through the site (the "Site").

This document is separate from and complements our Terms of Service, which governs purchases made on the Site. By accessing or using the Site, you agree to be bound by these Terms of Use. If you do not agree, you must not access or use the Site.

The Site and its entire contents, features, and functionality (including but not limited to all text, graphics, logos, images, product photography, and software) are owned by Plus Ultra Limited, its licensors, or other providers of such material, and are protected by Hong Kong and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

The PLUSULTRA® name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Plus Ultra Limited. You must not use such marks without our prior written permission.

These Terms permit you to use the Site for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Site, except as follows:

• Your device may temporarily store copies of such materials incidental to your viewing of those materials
• You may print or download one copy of a reasonable number of pages for your own personal, non-commercial use

You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to use the Site:

• To introduce any viruses, trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful
• To attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Site, the server on which the Site is stored, or any server, computer, or database connected to the Site

By providing any User Contribution, you grant Plus Ultra Limited a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, publish, and display such content for any purpose related to operating and promoting the Site.

You represent and warrant that any User Contribution you submit is accurate, does not infringe the rights of any third party, and does not violate these Terms. We reserve the right to remove or refuse to post any User Contribution for any reason, at our sole discretion.

The information presented on or through the Site is made available solely for general information purposes. We do not warrant the accuracy, completeness, or usefulness of this information. Any reliance you place on such information is strictly at your own risk. Product images are for illustrative purposes; actual products may vary slightly in appearance.

The Site may contain links to third-party websites or services that are not owned or controlled by Plus Ultra Limited, including our payment processor Stripe, Inc. and our e-commerce platform provider Shopify Inc. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that we are not liable for any damage or loss caused by your use of any such third-party content, goods, or services.

YOUR USE OF THE SITE, ITS CONTENT, AND ANY SERVICES OR ITEMS OBTAINED THROUGH THE SITE IS AT YOUR OWN RISK. THE SITE, ITS CONTENT, AND ANY SERVICES OR ITEMS OBTAINED THROUGH THE SITE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. NEITHER PLUS ULTRA LIMITED NOR ANY PERSON ASSOCIATED WITH PLUS ULTRA LIMITED MAKES ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY, OR AVAILABILITY OF THE SITE.

11. Limitation on Liability

TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO EVENT WILL PLUS ULTRA LIMITED, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE SITE, ANY WEBSITES LINKED TO IT, OR ANY CONTENT ON THE SITE, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

You agree to defend, indemnify, and hold harmless Plus Ultra Limited, its affiliates, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees arising out of or relating to your violation of these Terms or your use of the Site.

13. Governing Law and Jurisdiction

These Terms of Use and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region, without giving effect to any choice or conflict of law provision. Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Site shall be instituted exclusively in the courts of Hong Kong SAR.

14. Waiver and Severability

No waiver by Plus Ultra Limited of any term or condition set out in these Terms shall be deemed a further or continuing waiver of such term or a waiver of any other term. If any provision of these Terms is held to be invalid, illegal, or unenforceable, such provision shall be eliminated or limited to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

15. Entire Agreement

These Terms of Use, together with our Terms of Service and Privacy Policy, constitute the sole and entire agreement between you and Plus Ultra Limited regarding the Site and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Site.
